Some run to lead, some run to wreak havoc…
Nuisance candidates are those who are allegedly running for the sole purpose of confusing voters, be it for them having the same sounding name from the other candidates, or to mock the election process. Based on the terms of the Section 69 of the Omnibus Election Code, a nuisance candidate is defined as one who files a certificate of candidacy:
- to put the election process in mockery or disrepute; or
- to cause confusion among the voters by the similarity of the names; or
- in other circumstances which clearly demonstrate that the candidate has NO bona fide intention to run for the office and to prevent a faithful determination of the true will of the electorate.
For transparency, the Commission on Elections (COMELEC) recently shared a list of individuals they have classified as “nuisance candidates” on their social media platforms.
While those listed as nuisance candidates can still file a petition for reconsideration, the final decision rests with the COMELEC. It will determine whether or not these candidates will be allowed to continue their candidacy.
